<p>Taxation is one of the pillars for implementing public policies in Brazil, highlighting its importance as the main source of financing for state activities and as an instrument for promoting social justice and economic development. The analysis addresses how tax collection allows the State to invest in essential areas, such as health, education, security and infrastructure, contributing to improving the population's living conditions. In addition, the extra-fiscal function of taxation is discussed, which regulates behaviors and encourages practices aligned with the collective interest, such as environmental preservation and the reduction of social inequalities. However, the Brazilian tax system faces significant challenges, including its complexity, regressiveness and inefficiency in collection, which limit its redistributive potential and compromise fiscal equity. The article argues that tax reform is essential to make the system more progressive and efficient, in order to maximize the potential of taxation in enabling inclusive and sustainable public policies. The aim is to discuss whether the Tax Reform through Constitutional Amendment 132/23 is moving towards improving public policies and reducing the regressiveness of the system. As a methodological option, this research is exploratory in nature, whose chosen method of analysis was the deductive one and as a methodological procedure, the option was the bibliographic survey. It is concluded that the review and improvement of the tax system, aligned with the principles of fiscal justice and social function, are fundamental for the strengthening of public policies in Brazil and for the construction of a more equitable and developed society.</p>Marisa Rossignoli, Francisco Paulino da Silva Júnior, Francis Marília Pádua

<p>Family conflicts reflect the social, cultural, and legal transformations that Brazilian society has undergone in recent decades. The redefinition of gender roles, the plurality of family arrangements, and the weakening of traditional models contribute to the emergence of new forms of disputes within the family space. These conflicts, often marked by emotional and patrimonial disputes, demand more sensitive and multidisciplinary approaches capable of understanding the complexity of affective relationships and the centrality of human dignity in the proposed solutions. Therefore, this article aims to investigate whether transformative mediation is a mechanism for accessing a just and adequate legal order and an instrument for enforcing the personality rights of individuals involved in family conflicts. To this end, it will analyze the family, its new conceptions and contemporary models, the traditional model of justice, and the new consensual approach. This study will employ qualitative research, using a deductive approach and historical-comparative procedure, based on national and international bibliographic research, as well as quantitative research grounded in data from the Extension Program of the Center for the Judiciary for Conflict Resolution and Citizenship (CEJUSC – Unicesumar) for the period between 2023 and 2024. In conclusion, in the face of family conflicts, transformative mediation proves to be a more suitable mechanism than the traditional model of justice, as it is a collaborative instrument that integrates knowledge from Law and other sciences. This approach allows for a deeper understanding of family dynamics and the sociological dimension of the conflict, by promoting the empowerment of those involved and the mutual recognition of their interests and needs. It thus favors the construction of more satisfactory, lasting agreements aligned with the lived reality of the disputants. In this way, it decisively contributes to the enforcement of personality rights of family members and to the construction of a new family coexistence based on dialogue, respect, and peace.</p>Andrea Carla de Moraes Pereira Lago

<p>The main purpose of this study is to analyze the complexities inherent to the rise and implementation of constitutional dirigisme within the Brazilian legal system, especially in regard to its contemporary materialization through decisions issued by the Federal Supreme Court. The qualitative theoretical research formulation and the hypothetical-deductive method were used, which had as its primary component bibliographical research based on doctrine, in order to cover prominent authors at national and international level, in case law and constitutional legislation. Thus, during the inquiry, the historical evolution of the struggle to guarantee fundamental rights was analyzed, highlighting the periods of State of Exception and their impact on the constitutional formulation within the Constituent Power. As a result, the undoubted protagonism attributed to constitutional dirigisme by the Federal Constitution of 1988 was identified, which, however, has suffered from the risk of being transformed into a mere promise in the face of the inertia and silence of the ordinary legislator, especially in cases of danger of harm or effective violation of the rights of minorities and vulnerable groups, in which the strengthening of the Judiciary is identified, especially through the figure of the Supreme Court, which historically seeks to protect these constantly (re)marginalized groups.</p>Gabriela Borges da Cunha, Alexandre Naoki Nishioka, João Luiz Martins Teixeira Soares

<p>The anti-asylum policy has gained even more traction in recent years, particularly concerning the Judiciary. This is because the passage of time itself has necessitated a rediscussion of the topic for the purpose of changes and adjustments within the legal sphere and in psychiatric facilities. Therefore, there is an urgent need to observe the particularities and the degree of attention offered to women serving security measures, especially regarding legal evolutions, the obstacles still faced by the female gender in mixed hospitals across Brazil, and whether this group is more severely affected by invisibility. Thus, this study will bring to light and be supported by intersectional feminism and feminist criminology for discussions and analyses. The methodology used in this study combines the deductive method, encompassing a qualitative approach, as no new data will be produced. Instead, objective data already provided by SISDEPEN from the 16th cycle (jan/jun 2024) pertinent to the theme will be analyzed. Regarding the type of research, it is bibliographic, documental, and descriptive, while the content analysis will be an objective and systematic evaluation, where the data collection technique is based on previously disseminated references. To allow for greater interaction between the reader and the theoretical and objective data, the topic was discussed in a fluid manner, mainly to solidify the importance that so many layers possess in the struggle against and confrontation of the exclusions still prevalent when it comes to women interned in mixed-classification Brazilian psychiatric hospitals. It was therefore concluded that despite normative advancements, much progress is still needed, especially concerning a joint and effective effort involving the State, society, and the families of women admitted to psychiatric hospitals. <p>The Legislative Branch has, among its attributions, the possibility of creating laws that meet the demands of social inclusion and equity of the population, although a focus is observed on low-complexity proposals. The objective was to describe the perceptions of representatives of the Municipal Chamber of Porto Alegre/RS regarding a pilot service of scientific advice for the evaluation of equity and social inclusion, as well as to explore their perceptions about the legislative process around these themes. Ten semi-structured interviews were conducted, the content of which was subject to thematic analysis. The pilot service was considered acceptable and compatible with the objectives of the Legislative Branch, however there are uncertainties about its feasibility, fidelity of implementation and sustainability. In the interviews, three themes were explored: a) the paradox between the usefulness and viability of an instrument for evaluating the equity of bills; b) the strategies for reconciling the legislative process and electoral interests; and c) the disconnect between bills and the needs of the population. The Institutional and Discursive power formats emerge in the interviews as those that most influence the municipal legislature, where the space seems closed to participation and decision-making still occurs behind the scenes. Future initiatives to promote equity and social inclusion must take into account these characteristics of legislative work, focusing not only on the qualification of bills, but also on other areas of action.</p>Laura dos Santos Boeira, Laura Silveira Sainz, Ângelo Brandelli Costa

<p><span style="font-weight: 400;">O Novo Bolsa Família (n-PBF) representou a retomada do programa social de transferência condicionada de renda para famílias em situações vulneráveis após a vigência do Auxílio Brasil. A nova versão apresentou propostas que incluíram a atualização das informações do CadÚnico e mudanças nos valores destinados às famílias beneficiárias, com ênfase na priorização das famílias no acesso aos programas sociais e a ampliação da proteção das crianças na primeira infância com a promoção de iniciativas que fortaleçam a articulação intersetorial entre assistência social, educação, saúde, esportes, ciência e trabalho. Com base no contexto de queda de acompanhamento vacinal e do quadro de insegurança alimentar, o cenário de acompanhamento das condicionalidades de saúde de beneficiários nos municípios brasileiros emerge de um complexo contexto. Assim, o presente artigo objetiva avaliar a implementação do n-PBF no município de Fortaleza, no Ceará, tendo como enfoque o acompanhamento das condicionalidades de saúde de beneficiários do n-PBF na gestão municipal da localidade durante os anos de 2023 e 2024. A pesquisa adotará uma metodologia conjugando aspectos quantitativos e qualitativos ao operacionalizar taxas de indicadores no campo de avaliação de políticas públicas, além de promover a contextualização dos indicadores obtidos pela pesquisa por meio da análise bibliográfica de artigos, livros, revistas, jornais e demais fontes de informação.</span></p>Guilherme Arraes Alencar Cunha, Camila Arraes de Alencar Pimenta

<p class="Standard" style="margin-bottom: 0cm; text-align: justify; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Times New Roman',serif;">This article begins with an observation of the imposition of Eurocentric thinking in Latin America by European colonisers, who disregarded the knowledge of native peoples and their harmonious relationship with nature. It highlights the aftermath of colonialism, which reduced nature to the status of an object. The objective is to emphasise the decolonial shift and the contribution of emerging Latin American social theory to the constitutionalisation of nature as a subject of rights and good living. Regarding the methodological aspects, the research is exploratory and descriptive, based on a deductive approach and employing bibliographic and documental research techniques. The article concludes that decolonial thinking has influenced new Latin American constitutionalism, particularly in the constitutions of Ecuador and Bolivia, marking a paradigmatic shift away from Eurocentric thinking. By respecting cultural and ethnic plurality, breaking with the anthropocentric view, recognizing in constitutional texts the contributions of peoples silenced by colonialism, and including nature as a rights-holder, the new Latin American constitutionalism also promotes non-hegemonic epistemologies. </span></p>Thaís Rúbia Roque, Haide Maria Hupffer

<p>This article seeks to investigate the implementation of legislation regarding a Decision Analysis that triggers intersectionality through the parameters of ethnicity, sex and age with elements to guarantee the right to social security protection, specifically, maternity pay for indigenous women. The study adopts the Decision Analysis Methodology, supported by the specific intersectionality protocol for indigenous women, thus seeking to provide a basis for the researched object. In the special resource under analysis, age is intertwined with indigenous culture, specifically related to the beginning of menarche and work activity and breaks the colonialist discourse of the intermediary to add the right to the social security system, specifically maternity pay. <p>Este artigo teve como objetivo analisar o cenário de conectividade na microrregião do Bico do Papagaio, com vistas a subsidiar a implementação do Programa Agora – Edital 2M, iniciativa voltada à inclusão sociodigital de mulheres quebradeiras de coco. Para tanto, foi realizada uma pesquisa baseada em dados secundários, utilizando estatística descritiva para apresentação de variáveis relacionadas à disponibilidade e ao acesso às Tecnologias da Informação e Comunicação (TIC) nos municípios que compõem a região. Os resultados indicaram uma expressiva heterogeneidade entre os municípios, evidenciando desigualdades significativas de acesso à conectividade. Esse quadro pode comprometer a efetividade de políticas públicas voltadas ao fortalecimento da infraestrutura digital no meio rural, bem como dificultar a plena implementação e o alcance dos objetivos do Programa Agora. <p>O objetivo deste estudo foi mapear as violências contra crianças e adolescentes de povos e comunidades tradicionais do Brasil (PCTs) relatadas em produções acadêmicas. Para a organização dos dados, utilizou-se o software Ryyan e, para a sistematização, análises descritivas de frequência e análise de referência cruzada do software SPSS (versão 2.3). Foram encontrados 137 trabalhos sobre crianças indígenas, quilombolas, ribeirinhas, de terreiro, ciganas, caiçaras, faxinalenses, quebradeiras de coco babaçu, apanhadoras de sempre-vivas, geraizeiras, pantaneiras e pomeranas. A infância e a adolescência dessas crianças foram marcadas por discriminação, negligência, violências física, emocional e sexual, sobretudo do Estado e da sociedade. Perceberam-se violações aos direitos e garantias fundamentais, como mobilidade e território, identidade cultural, saúde, educação e alimentação, tendo como ponto central a luta pela terra e defesa do modo de vida. Esta pesquisa evidenciou a importância de um olhar mais atento para as realidades dessas populações. Destacou-se a importância das instituições na construção de um ambiente mais equitativo, por meio de estratégias de intervenção e políticas públicas específicas que promovam a proteção e os direitos desses grupos, combatendo o discurso de ódio e o estigma social.</p>Catarina Gordiano Paes Henriques, Mariana Bonomo

<p><strong>Abstract: </strong>This article examines the impacts of Artificial Intelligence on the Brazilian judicial system, with an emphasis on incarcerated women belonging to marginalized groups, particularly Black and low-income women. The increasing use of algorithms in the penal sphere tends to perpetuate and exacerbate structural inequalities in a historically discriminatory system. The study investigates the following research question: how can Artificial Intelligence amplify these barriers and contribute to the rise of female incarceration in Brazil? Adopting the hypothetical-deductive method and a qualitative approach, the study is based on the hypothesis that Artificial Intelligence, instead of promoting justice through efficiency, reinforces social stigmas and results in unequal judicial decisions, as the opacity of algorithms compromises transparency and the legitimacy of justice. The findings indicate that algorithmic systems reproduce stereotypes, highlighting the urgent need for ethical regulation and oversight mechanisms in the use of Artificial Intelligence within public security and judicial systems.</p> <p> </p>Georgea Bernhard, Marli Marlene Moraes da Costa

<p>With the increased use of the internet and new social dynamics, new challenges have arisen in protecting personal data. One of these challenges lies in internet use by children and adolescents, which becomes even more relevant due to the protection based on the absolute priority given to these individuals. This article therefore addresses the issue of inappropriate or unauthorized access to applications and technologies by children and adolescents and the irregular processing of their data in the absence of specific consent, as provided for in the General Data Protection Regulation. As for the dissertation method, the legal-social approach is used, to highlight and analyze the contradictory relationships of the proposed problem. In addition, the legal-propositional method is also used, as it questions the institute of data protection, the autonomy, and capacity of children and adolescents in the technological scenario, and proposes regulatory standards appropriate to the Applied Social Sciences. As a proposal for risk mitigation, specific regulatory guidelines are proposed, based on a brief Regulatory Impact Assessment, for the use of social networks and obtaining consent, based on the General Data Protection Regulation, the Law on Agencies, and the Economic Freedom Law.</p>Sthéfano Divino, Ana Beatriz Pacheco

<p>Esta pesquisa investiga em que medida o regime previdenciário do segurado especial concretiza a sua aplicação às mulheres, levando em conta o trabalho reprodutivo realizado dentro do regime de economia familiar. Adota-se como hipótese que a proteção previdenciária constitucional da segurada especial, conferida por meio da redução da idade para a aposentadoria e da relativização de requisitos obrigatórios, constitui uma política pública social que leva em consideração a vulnerabilidade das mulheres e reconhece como um risco social a ser protegido. A justificativa da presente pesquisa se dá em traçar e estabelecer elementos para a manutenção da idade nas aposentadorias rurais das seguradas especiais, demonstrando que há aspectos que perpassam a vulnerabilidade das mulheres nessa proteção. Como marco teórico, foram escolhidos os escritos de Mariana Canotilho e Judith Butler, a fim de trabalhar a interrelação da vulnerabilidade e da proteção previdenciária. <p>This article investigates the constitutionality of the General Law of Universities of Paraná (Law No. 20.933/2021) through the lens of the tension between the state's managerial efficiency model and the principle of university autonomy, enshrined in Article 207 of the Federal Constitution. The analysis traces the genesis of the norm, characterized by the government's intent to parameterize the funding and personnel management of State Higher Education Institutions (HEIs), and the subsequent judicialization of the controversy via Direct Action of Unconstitutionality No. 0067337-19.2022.8.16.0000. Grounded in specialized legal doctrine, the study examines the jurisdictional response of the Court of Justice of Paraná (TJPR). <p>O artigo faz análises críticas sobre os trabalhos da Justiça Especial de Paz da Colombia abordando os chamados macro-casos julgados contrários do Direito Internacional Público. Os julgamentos levam em conta também o documento chamado de “Convocatoria a la Declaración de la Comisión para el Esclarecimiento de la Verdad, la Convivencia y la No Repetición-PAZ GRANDE INFORME FINAL. Trata-se de um importante documento do órgão “Comisión para el Esclarecimiento de la Verdad, la Convivencia y la No Repetición, 2022”. As narrativas aprimoram fatos dos julgamentos nesse tipo de Justiça de Transição, que julgou dois e analisa outros dos maiores casos. Há uma abordagem histórica dos procedimentos da JEP, com alguns destaques sobre as normas do Direito Internacional Público. Pelo método dedutivo busca-se apontar os limites desses julgamentos usando a jurisprudencia da Corte Interamericana e tratados internacionais de direitos humanos, como Estatuto de Roma e Protocolo Adicional da Convenção de Genebra ratificados pela Colombia. As conclusões estão em capítulo próprio e servem para os autores apontarem os problemas e as soluções para reparações integrais, incluindo punições e o direito à verdade, que veio com um relatório.</p>Sérgio Tibiriçá Amaral, Maria Fernanda de Toledo Pennacchi Tibiriçá Amaral

<p>The article addresses the projection of human dignity in the genesis of cooperativism and its relation to the affirmation of personality rights. The general objective is to examine the relationship between the emergence of cooperativism in the nineteenth century and the construction of personalist values that would later be incorporated into the legal system as personality rights. The specific objectives are: a) to examine the historical process that gave rise to cooperativism; b) to verify how human dignity was contemplated through cooperative practices; and c) to relate the historical experience of cooperativism to the future protection of personality rights. The results indicate that cooperativism, by adopting principles such as self-management, solidarity, and equality, anticipated values that would later be consolidated as personality rights, even before their formal recognition in the legal order. Cooperatives were not limited to an economic function but also promoted inclusion, democratic participation, and the moral development of their members. Thus, they proved to be instruments of affirmation of dignity and of the construction of foundations for the present and future protection of personality rights. The methodology employed was the deductive method, combined with a narrative literature review, allowing for the establishment of connections between the historical experience and the contemporary normativity of human person protection.</p>Dirceu Pereira Siqueira, Andryelle Vanessa Camilo Pomin
